Victim of D A Corruption, Fraud Forcibly Removed from Courthouse Building, Threatened with Arrest!!!

The following letter is from Alameda County District Attorney and Oakland City Attorney fraud victim Abdul-Jalil al-Hakim to an over 40 year personal friend and family client, the Honorable Judge Leo Dorado regarding an encounter with District Attorney henchman Bob Connor whom forcibly removed al-Hakim from the Rene Davidson Courthouse building and threatened to arrest al-Hakim if he ever returned. Connor is very well known to both parties.
al-Hakim has filed a formal complaint against the Alameda County District Attorney office and the City Attorney’s John Russo of Oakland and Jayne Williams of San Leandro and their City Attorney’s office administrations including the law firm of Meyers Nave, on June 7, 2010. After several conversations with the Alameda County District Attorney office, District Attorney Nancy O’Malley assigned the case to Assistant District Attorney Kevin Dunleavy. After his review and several more conversations with al-Hakim, Dunleavy decided to assign the case for investigation. al-Hakim also filed the complaint with Oakland City Auditor Courtney Rudy, long rumored to be Russo’s love interest, only to have her refuse to investigate  the complaint, though she is compelled to do so by the passing of Russo’s “Oakland ROAR” anti-corruption program. The program was alleged to revive the confidence of the citizens of Oakland in the City Administrators. She received the 200 page complaint with audio CD as witnessed by the voice mail message left for al-Hakim by her assistant Joe Macaluso. al-Hakim will petition President Obama and U. S. Attorney General Eric Holder to expand the initial investigation of a complaint filed in 2005 by demanding a change in this criminal, tactical policy of isolation, victimization, criminalization and the attempted entrapment of the victim, including the use of government initiated, Nixon era “White House Plumbers” and CoIntelpro style dirty tricks! This civil conspiracy has brought into play County and Sate Agencies to further it’s continued investigation of al-Hakim whom the defense admitted in 1998 has been surveilled for years and continues today with the compromising of many agents and informants covers due to their sloppiness. These actions of Dunleavy, and Connor are just the latest example of the continuing efforts of law enforcement to silence and eliminate al-Hakim as their adversary when he has caught and exposed them as they have been entrapped in their own crimes!After the encounter with Connor, al-Hakim spoke with District Attorney Matt Golde and Dorado regarding his treatment and called O’Malley to voice his extreme concern wherein he received a return call from Dunleavy. Here’s Dunleavy’s second call stating the he will speak with the Department of Child Support Services attorney that had to admit in court several times that they and the D. A.’s office had committed fraud, embezzlement, and theft against al-Hakim and his family. When al-Hakim refused to pay for the D. A.’s fraud, they attempted to extort the money from him by suspending his drivers license and revoking his passport!
After no response from the D. A.’s office, the following letter of today ensued.

Dear Judge Dorado,
First, let me say “Happy Holidays” to you and the family! I know that everyone must be doing great, and since the kids are not getting any younger, I guess you and I can not be 21 any longer! What’s this I hear about you having hip replacement and moving to Juvenile Court? We have some catching up to do, which was part of the reason I was coming to see you when I was removed from the courthouse building!
I have awaited your response to our last conversation and the results of your inquiry into the District Attorney’s actions wherein hopefully we could meeting to discuss the above very serious concerns.
It is unfathomable that such a thing could happen in today’s highly charged racial, political, and law enforcement versus community interactive environment, especially in Oakland and Alameda County where deadly force seems to be the rule rather than the exception. We have also discussed my previous interaction with officer Bob Connor during my Oakland Police Burglary case which you are aware of and know that he is not someone I trust or would interact with in any manner. He clearly tried to put me in harms way where I could/would have been killed! I made it clear then that I never intended to speak or have any contact with him ever again in life.
To allow the D. A.‘s office to handle me and my complaint in such a Gestapo fashion and to use you as a ruse is unacceptable, needs to be investigated, the responsible parties held accountable and punished. I have yet to receive any response from Nancy O’Malley.     Clearly something must be done as I have waited for you to get back to me to move this process forward. There is no circumstance or law that can justify this use of force, intimidation, and threat of imprisonment under the guise and color of law!. You know that I will not allow this continuing injustice to go on unnoticed so, what time is best for you since I want to meet as soon as possible!
We are all very busy, and especially this time of year, but I have been speaking to the D. A.’s office about this matter since June of this year with the above results. The matter of the fraud and corruption committed by the District Attorney and Oakland City Attorney and I are not going to magically disappear so let’s address it and move on.
I have litigation that was to be filed in November the day of my being forcibly removed from the court house and threatened with arrest if I returned. I was unable to complete that filing, wherein the D. A.’s office has compromised these suits and this issue also must be corrected ASAP!
Please respond with a time ASAP and I will accommodate that time and it can be after working hours or the weekend, if it’s best for you. We have some catching up to do anyway.
Thank you and I welcome and look forward to your immediate response with the furthering of the litigation and resolution of this ongoing case.

Glenn Burke’s journey through baseball began and ended in Oakland, California. His sports career had many stops along the way, starting as a multi-sport star at Berkeley High School, followed by a brief stint at the University of Nevada, Reno as a prized basketball recruit, and then moving into professional baseball with the Los Angeles Dodgers, being hailed by one coach as “the next Willie Mays.”

Early in his career, Burke felt he had to hide his true self from his teammates.  Later, when he began to reveal glimpses into his sexuality the baseball establishment began to close him out.  Out. The Glenn Burke Story, a one-hour documentary produced by Comcast SportsNet Bay Area, tells the dramatic tale of Burke’s legacy as the first openly homosexual Major League Baseball player.  From his Major League debut in 1976 and starting Game One of the 1977 World Series for the Dodgers to subsequently being traded to the Oakland Athletics the next season, and then walking away in 1980 from the game that he deeply loved, Comcast SportsNet follows one of baseball’s most dramatic arcs.

Many of Burke’s teammates were aware of his homosexuality during his playing career, as were members of management. And many of those teammates believe that his sexuality – and the reaction it provoked – led to the premature derailment of his baseball career.

Out. The Glenn Burke Story tells the tumultuous story of the wedge that was driven between Burke and the Los Angeles management, the ensuing similar situation in Oakland that led to Burke’s abrupt retirement, and the hero’s welcome that Burke received in San Francisco’s Castro District after he left professional baseball.

Comcast SportsNet’s narrative follows Burke through his public announcement of his homosexuality in a 1982 Inside Sports magazine article (‘The Double Life of a Gay Dodger’) and on The Today Show with Bryant Gumbel, to his subsequent downward spiral to drugs, prison, and eventually living on the same San Francisco streets where he was once hailed as an icon.

Burke’s story took on another level of tragedy when he was diagnosed with AIDS in 1994.  Yet at the end of his life, the game that he claimed abandoned him so many years before reached out to one of its own. The A’s found Burke and provided him with constant support in his final months, as did some of his former teammates.

Glenn Burke passed away on May 30, 1995 at the age of 42 of AIDS-related complications.

Abdul-Jalil al-Hakim (Childhood friend and sports agent):
On Burke’s homosexuality and the homophobia in Major League Baseball:  “It was uncompromising on both ends.  Glenn was comfortable with who he was. Baseball was not comfortable with who he was.”

Claudell Washington:
On Oakland Athletics manager Billy Martin introducing Burke to his new teammates in spring training:  “He was introducing all the players and then he got to Glenn and said, ‘Oh, by the way, this is Glenn Burke and he’s a faggot.’”

Davey Lopes:
On Burke’s trade to the A’s:  “You don’t break up, disrupt a team going as well as it was going to make changes.  I didn’t feel it was going to make us a better ball club.  Billy North was not going to make us, at that time, any better of a ballclub.  Probably not the real reason why things happened.”

Dusty Baker:
On the rumors of Burke’s sexual preference and his trade to the A’s:  “I think the Dodgers knew; I think that’s why they traded Glenn.”

Reggie Smith:
On the suspicions on Burke’s sexuality:  “I certainly didn’t want to accuse him of that, because one thing’s for sure – at that time period, it was a kiss of death for a ballplayer.  He would’ve been excused from the game, so to say.”

Vincent Trahan (Berkeley High School classmate):
On Dodger management and their suspicions:  “Al Campanis and Walter O’Malley had called him into the office and offered him $75,000 to get married.  And Glenn, being his comic self, said, ‘I guess you mean to a woman?’”

On the Dodgers’ controversial trade of Burke to the A’s:  “He was hurt because they traded him not for his baseball ability but for his life choice.”

Lyle Spencer (MLB.com, former Los Angeles Dodgers beat writer):
On the reaction of Burke’s teammates the day he was traded:  “I was shocked that he was traded… I walked into the clubhouse…and guys were visibly distraught over the trade, and that told me that my sense of how important he was to them internally was accurate.  I even remember a few players crying when they found out about it at their lockers, which is stunning.”

Billy Bean:
On dealing with discrimination:  “The closet hurts people – forever.  Everyone’s career ends, but to do it because you don’t feel you belong there when you’ve proven that you do is damaging.  And it affects everything, and I’m sure that’s why Glenn swam in the waters of drugs and alcohol – to take away his frustration.”

Claudell Washington:
On hearing about Burke contracting AIDS:  “I was stunned at that time. A person that I’d known, loved, and respected had contracted an illness like that and was suffering.”

Lutha Davis (Sister):
On AIDS:  “A lot of people were scared because I think, at the time, you didn’t know whether you can just breathe on somebody and get AIDS or just touch them.”

Pamela Pitts (Oakland A’s Director of Baseball Administration):
On Burke’s reaction to hearing the A’s would help him:  “Glenn started to cry and said, ‘I’ve been told you’re going to help me. I can’t believe someone wants to help me.’”

On Burke’s death: “I do believe he was in a much better place.  His demons were gone.”

Ted Griggs, Vice President and General Manager, Comcast SportsNet Bay Area stated, “As an East Bay native, I knew all about Glenn Burke’s legendary athletic feats at Berkeley High.  I followed his career with the Dodgers and A’s throughout the late seventies, and watched and read with great interest when he came out on The Today Show with Bryant Gumbel and in Inside Sports Magazine.  I was saddened by his tragic death and thought at the time that his was a compelling story that should be told one day.  This documentary allows Glenn’s family, friends, and teammates to tell that story, and it is enhanced with the narration of Dave Morey, one of the most respected voices in Bay Area radio.”

November 16, 1952 Glenn Lawrence Burke is born in Oakland, California.

1970 In his senior year, Burke is named Northern California’s High School Basketball Player of the Year after leading the Berkeley High School Yellowjackets to a 32-0 record and winning the Tournament of Champions.

1971 Burke attends Merritt College in Oakland where he plays baseball and basketball, eventually earning a scholarship to the University of Nevada, Reno.

June 6, 1972 Burke is drafted by the Los Angeles Dodgers in the 17th round of the 1972 amateur draft.

1972 Burke makes his professional debut for the Ogden Dodgers of the Rookie level Pioneer League.

1972 Burke is promoted to Low-A ball and plays 41 games for the Spokane Indians of the Northwest League.

1973 Burke hits .298, splitting time between Dodgers Single-A affiliates Daytona Beach and Bakersfield.

1974 Burke becomes the University of Nevada, Reno’s starting point guard during the preseason.  He scores 22 points against USC in a preseason game, but an early season injury convinces him to hang up his sneakers and focus on baseball.

1974 In his best season in the minors, Burke is hitting .338 at Single-A Bakersfield when he is promoted to AA Waterbury of the Eastern League.

April 9, 1976 Burke makes his major league debut with the Los Angeles Dodgers against the San Francisco Giants.

1977 According to Burke’s autobiography, Dodgers general manager Al Campanis offers to pay for a lavish honeymoon if Burke agrees to get married.  Burke angrily refuses, seeing the offer as a way to cover up his homosexuality.

October 2, 1977  Dodgers teammate Dusty Baker hits his 30th home run of the season and is greeted at home plate by Burke whose hand is raised in the air.  Baker does the same, and they slapped hands producing the first “High Five” in sports history.

October 11, 1977 Burke starts Game One of the 1977 World Series against the New York Yankees.
May 17, 1978  The Dodgers trade Burke to the Oakland Athletics in exchange for outfielder Billy North.

June 4, 1979 Burke plays in his last major league game and then makes an abrupt mid-season departure from the A’s that leads to his eventual retirement.

1980 Burke comes out of retirement and reports to A’s spring training.

1980  At the young age of 27, Burke permanently retires from professional baseball due to personal differences with the A’s management.

October 1982 Burke becomes the first openly gay Major League baseball player by publically acknowledging his homosexuality in an Inside Sports magazine article entitled “The Double Life of a Dodger.”

Burke is a guest on NBC’s The Today Show and discusses the Inside Sports article with anchor Bryant Gumbel.

August 28, 1982  San Francisco hosts the inaugural Gay Games. Burke participates and earns gold medals, in track in the 100 and 220 meter sprints and as a member of both the men’s basketball and softball teams.

January 27, 1983 NBC’s “Cheers” airs the episode “Boys in the Bar,” in which Sam Malone (played by Ted Danson) supports a former teammate who publicly acknowledges his homosexuality.  The show is based on Burke’s announcement the previous year.

1986  Burke competes in Gay Games 2 on the men’s basketball team.

1987  Burke is hospitalized after being hit by a car in San Francisco, breaking his leg in four places.

1988  Burke is arrested for drug possession and briefly jailed.

1991  Burke pleads guilty to grand theft and possession of a controlled substance and serves six months in San Quentin penitentiary.

1994  After a series of medical complications, Burke is diagnosed with AIDS.

November 18, 1994 Berkeley Mayor Shirley Dean presents Burke’s family with a plaque and proclaims the first “Official Glenn Burke Day.”

May 30, 1995 Glenn Burke, 42, passes away in San Leandro, California due to AIDS-related complications.

July 1995 Burke’s autobiography “Out at Home, The Glenn Burke Story” is published and released.

On Burke’s homosexuality:  “It was uncompromising on both ends.  Glenn was comfortable with who he was. Baseball was not comfortable with who he was.”

December 2010 Haiti Relief Mission
 

Thank you in advance for your continued support and prayers and I hope this brief note finds you and yours in the best of health and spirits. The Aaron & Margaret Wallace Foundation with Stepping Together are planning a December Haitian Relief Mission and the dates have been finalized as November 30, 2010 to December 7, 2010! We will again be working with Arch Bishop Joel Jeune, one of the most powerful men in Haiti as head of the Catholic Church, and the people of Haiti that he serves at Grace Village, the compound of his organization Grace International, in the Carrefour district of Port-au-Prince, Haiti, the epicenter of the earthquake.
As you know, the Village has become a refuge center, housing almost 30,000 quake victims and the compound is located precisely where the earthquake did the most damage. Most of the homes and neighborhoods surrounding Grace Village have been highly damaged, if not devastated, leaving hundreds of thousands of people dead and injured.
We will be working and living (in guest houses) on site, providing OBGYN care, possibly primary care (depending on staffing), health education and social support including mental health counseling. Our focus for OBGYN will be developing an ongoing clinic as there is a great need for prenatal services.

Also, we are looking for providers who are interested in teaching as this was an urgent request from our hosts but this is dependent on us hiring translators. As such we are looking for Kreyol-speaking nurses and providers to assist us. Currently there is an RN from New York City who is willing to attend however she is in need of financial assistance. This particular RN worked with us on previous mission and her help was invaluable. If you or anyone in your organization can fund her trip costs that would be fantastic.
Other services are dependent on getting sufficient volunteers. So spread the word, this mission is open to all volunteers but our capacity is limited and preference will be given to early responders. If they have not participated on one of our previous missions then they should send their CV and the completed Volunteer Waiver forms as soon as possible. The forms are available upon request.

OAKLAND CITY ADMNISTRATOR TO MEET WITH al-HAKIM
ON FATE OF CITY ATTORNEY JOHN RUSSO
Oakland City Administrator Dan Lindhiem is scheduled to meet with Abdul-Jalil al-Hakim on Monday, September 20, 2010 to discuss the fate of City Attorneys John Russo; Managing Principal Partner of the law firm Meyers Nave Former Oakland and current San Leandro City Attorney Jayne Williams; and their respective City Attorney’s Offices in response to al-Hakim’s corruption complaint. This meeting comes on the heels of the Alameda County District Attorney Nancy O’Malley assigning the case to Deputy District Attorney Kevin Dunleavy whom after his review and several more conversations with al-Hakim, decided to assign the case for investigation.

 

al-Hakim has presented uncontested, irrefutable, uncontroverted evidence that the Parties named herein have committed CORRUPTION, COLLUSION, CONSPIRACY, EXTRINSIC FRAUD, FRAUD UPON THE STATE, SUBORNATION AND SOLICITATION OF PERJURIOUS TESTIMONY, PROVIDING LITIGATION CASE FILES AND EVIDENCE TO DEFENDANTS, SPOLIATION OF EVIDENCE, FABRICATING EVIDENCE AND PLANTING FABRICATED EVIDENCE IN LITIGATION CASE FILES , ATTEMPTING TO DECEIVE THE PUBLIC IN SUPPORT OF DEFENDANTS LITIGATION THEORY, CALUMNY DECEIT by giving the case files to defendant Stephan Barber and others of the law firm Ropers, Majeski, and Ronald J. Cook, Randy Willoughby, Alex Stuart, Bradley Bening and others of the law firm Willoughby, Stuart & Bening for nearly a year; then clearly constructed fraudulent fabricated evidence in 1999 and planted that evidence favorable to the defendants in the files SIX years AFTER the case was closed; engaged in spoliation of remaining evidence in the court files from 1991; and fostered witness testimony based on this planted evidence in the al-Hakim v CSAA and the underlying Rescue Rooter case that was created thru EXTRINSIC FRAUD with accompanying testimony procured thru admitted suborned and solicited perjurious acts by John Russo and others, they engaged in actions to destroy the litigation of al-Hakim’s legal case; they engaged in actions to coverup their unlawful acts; they committed, aided and abetted this criminal activity with this unpardonable breach in the chain of custody of the court files to accommodate the defendants litigation strategy in both the CSAA and the underlying Rescue Rooter case. They have committed criminal violations of the Civil Code, Business and Professions Code, the Rules of Professional Conduct, and the California Cannons strikes at the heart of al-Hakim’s fundamental civil and human rights, and the right to due process under the law guaranteed by the United States Constitution Amendments and the California Constitution. These actions qualify as a Hate Crime under the Unruh Rights Act, the Ralph Civil Rights Act and the Bane Act, while they are clear crimes of religious bigotry and intolerance, as such, this conduct rose to the level of consideration for a Federal Crime and a Civil Rights violation because the City Attorney’s Office operates “under the color of law” and certainly the violation of anyone’s civil rights is a federal crime. This deprivation of al-Hakim’s civil, human and due process rights by the law enforcement body of the City Attorneys’ office of Oakland “rise to the level of criminal activity and misconduct” by local and federal law enforcement officials. al-Hakim has asserted that as relevant to whether these actions of Jayne Williams, John Russo, the Oakland City Attorneys Office and al-Hakim’s own insurance carrier, CSAA, there are equally as serious charges with regards to the actions of Jayne Williams; John Russo; the Oakland City Attorneys Office; CSAA; Cook and Willoughby Stuart & Bening; Barber and Ropers Majeski participation in the orchestration of defendants Rescue Rooter and Bay Area Carpet’s defense strategy against their client rather than represent al-Hakim as required by law. The witness testimony and evidence that was procured thru admitted suborned and solicited perjurious testimony by them and the defendants, they engaged in actions to interfere with their client and litigant’s legal case, engaged in actions to coverup the unlawful act of suborn and solicited perjurious testimony, committed fraud upon the court of the State of California, aided and abetted criminal activity, committed willful, criminal and corrupt perjury, fraud, conspiracy to commit fraud, conspiracy, subornation of perjurious testimony and solicitation of perjurious testimony, fraudulent concealment, spoliation of evidence with the City of Oakland, their unpardonable breach in the chain of custody of the court files, has committed patterned willful, criminal, and corrupt deception and fraud upon the court, extrinsic fraud, spoliation of evidence with the disappearance of court records, and have unclean hands.

The Parties have all failed and refused to provide the information sought by al-Hakim, and further failed and refused to appear under court ordered subpoena for deposition testimony twice and under court ordered subpoena for trial testimony and have caused al-Hakim and family to be forced from their $1 million plus home and office, foreclosed from an over $20 million law suit, and multi million business for 13 years thru the City Attorneys’ violation of the business and professional codes, extrinsic fraud, subornation of perjurious testimony, committing these acts under the color of law with unclean hands, and should be prosecuted to the full extent of the law.

Since 1999 Managing Principal Partner of the law firm Meyers Nave, former Oakland and current San Leandro City Attorney Jayne Williams; Oakland City Attorney John Russo, Mark Morodomi, Randy Hall, Janie Wong, Anita Hong, Sophia Li, Demetruis Shelton- current President of the National Bar Association, Elizabeth Allen, Erica Harrold, Michele Abney, Eliada Perez and the Oakland City Attorney’s Office has always maintained that the City of Oakland case file in the Abdul-Jalil al-Hakim vs. The City of Oakland matter from the 1991 backup were missing and were last requested for viewing by defendant Ron Cook. Emails and phone calls from Oakland City Attorney Russo’s press director Alex Katz to Gabrielle Wilson and Sasha Lilley, interim Program Director at KPFA, with a cc: to Mark Moromodi, Supervising Deputy for the Oakland City Attorney, proclaiming that City Attorney John Russo was not involved in the case, yet he wanted her to answer questions as to why she wanted to provide a forum for the plaintiff, al-Hakim whom he alleged had posted threatening videos about John Russo. We provide a legal assistance referral service that advocates for various legal services and support programs to the wrongfully accused, under-represented, overly jailed; wrongfully convicted; economically, mentally, and physically challenged; the poor and homeless; the undereducated; undeserved; people living with symptomatic HIV and AIDS; substance abuse; seniors 55 years and older; prenatal women; at risk youth; and homebound people living with serious illness.

The people we serve are men, women and children living in San Francisco/ Oakland Bay Area in California are of different race, faith, culture, age, gender, sexual orientation and income levels that simply need help to transform their lives from people in need to become a productive member of a society in which all persons flourish.

Although our services are FREE to those in need, we do not charge any fees to any attorney that uses our referral service nor do we ask that any attorney that uses our service to provide their services to anyone Pro Bono. That is the choice of the attorney, however any discounts or Pro Bono services that are provided to anyone is on the basis of the agreement between the parties.

The users of our service complete an exhaustive legal intake form so that we can best assist them in their area of need. We have received legal intake forms for San Francisco-Oakland Bay Area residents requesting legal advice and services in the areas of:

1) Defense of the Gang Injunction in Oakland filed by the Oakland City Attorney’s Office;
2) Filing of a Plaintiff’s Claim/Action against a local school district;
3) Filing a Medical Malpractice/Negligence Action against a local care provider in the death of client due to blood contamination through IV;
4) Defense of an Oakland Housing Authority initiated fraud complaint filed by the Alameda County District Attorney due to confusion from the exclusion of business, not personal, income;
5) An Entertainment Law action to recover record royalties;
6) Filing a Plaintiff’s action against a local auto repair shop when an auto left for repair was stolen from the shop and found stripped;
7) Filing a Plaintiff’s action against home insurance carrier from fire damage to adjacent neighbors home.
